HIPPA Compliance 

Over the prior two decades, the federal government passed several important laws regarding personal privacy. The first of this legislation was the Health Information Portability and Accessibility Act (HIPPA), passed in 1996. After the passage of HIPPA, the following federal legislation has been enacted: Family Educational Rights Privacy Act (FERPA), Gramm Leach Bliley Act (GLBA), Fair Credit Reporting Act (FCRA), Sarbanes-Oxley (SOX), Federal Privacy Act.

Fair and Accurate Credit Transaction Act (FACTA), Health Information Technology for Economic and Clinical Health (HITECH), American Recovery and Reinvestment Act of 2009 (ARRA).

These laws require organizations to protect, preserve and remediate numerous privacy issues, comments and examinations. 

Recently we have read about privacy losses from stolen laptop computers, web site hackers and malicious damage to customers credit use. Please be aware of the growing criminal technological piracy of protected personal data. No one is immune or safe if you visited a doctor, took a class, paid your utility bill on-line or made a retail purchase. We are all at risk.

The HITECT act and forty-four states (including Idaho) have now enforced privacy and security breach legislation so when a breach of protected personal information takes place, the business must notify all customers that their personal data may have been compromised, even if the information had not been used. The loss of data and the responsibility to recover, notify and monitor usage of privacy material is costly and time consuming. Most organizations are not equipped to mitigate their responsibility at the time of a discovered loss.
